Welcome to CertForge. These Terms of Service ("Terms") govern your access to and use of the CertForge website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not access or use the Service.
1. Acceptance of Terms
By creating an account, accessing, or using CertForge, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Description of Service
CertForge provides an online platform for IT certification preparation, including:
- Practice questions and exams aligned with official certification curricula
- Progress tracking and performance analytics
- Adaptive learning recommendations
- Study resources and educational content
CertForge reserves the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
The Service may be offered in beta or early access form. Features may be incomplete, subject to change, or experience interruptions, and certain functionality or stored data may not persist.
Some content may be generated using artificial intelligence and may not always be accurate or complete. CertForge is an educational and assistive tool, not an official authority or definitive source for certification outcomes.
3. User Accounts
3.1 Account Creation
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your information to keep it accurate
- Safeguard your account credentials and notify us immediately of any unauthorized use
- Be responsible for all activity that occurs under your account
3.2 Age Requirement
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have obtained consent from your parent or legal guardian.
3.3 Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service or other users.
4. Subscriptions and Billing
4.1 Subscription Plans
CertForge may offer subscription plans with varying features and pricing. By subscribing, you agree to pay all applicable fees.
4.2 Payment Processing
All payments are processed securely through Stripe. You authorize CertForge and Stripe to charge your designated payment method on a recurring basis according to your subscription plan.
4.3 Automatic Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings.
4.4 Refunds
Refunds are generally not provided, except as required by law, but may be considered on a case-by-case basis. If you cancel your subscription, you will retain access to paid features until the end of your current billing period.
4.5 Price Changes
We reserve the right to modify subscription pricing. Any price changes will be communicated to you in advance and will take effect at your next billing cycle.
5. Intellectual Property Rights
5.1 Ownership
All content, features, functionality, and materials available through the Service, including but not limited to:
- Practice questions and exams
- Study materials and resources
- Software, code, and algorithms
- Text, graphics, logos, and images
- Design, structure, and "look and feel"
are owned by CertForge or its licensors and are protected by copyright, trademark, and other intellectual property laws.
5.2 Limited License
Subject to your compliance with these Terms, CertForge grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.
5.3 Restrictions
You may not:
- Copy, modify, distribute, sell, or lease any part of the Service
- Reverse engineer, decompile, or attempt to extract source code
- Remove or alter any proprietary notices or labels
- Use the Service to create a competing product or service
- Share your account credentials or subscription access with others
6. User Content and Conduct
6.1 User-Generated Content
You may have the ability to submit feedback, suggestions, or other content. By submitting content, you grant CertForge a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and distribute such content for any purpose.
6.2 Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to the Service or other user accounts
- Interfere with or disrupt the Service or servers/networks connected to the Service
- Transmit viruses, malware, or other harmful code
- Scrape, harvest, or collect data from the Service using automated means
- Impersonate any person or entity or misrepresent your affiliation
- Harass, abuse, or harm other users
- Share practice questions or proprietary content outside the Service
- Use the Service to engage in academic dishonesty or violate the terms, rules, or exam integrity policies of any certification provider
We reserve the right to investigate and take appropriate action, including suspension, termination, rate limiting, and legal action, for violations of this section.
We also reserve the right to limit, throttle, or otherwise manage usage of the Service to ensure fair access, control abuse, and maintain system stability.
7. Third-Party Services and Content
The Service may contain links to third-party websites or integrate with third-party services (such as Auth0 and Stripe). CertForge is not responsible for the content, policies, or practices of third-party services.
Your use of third-party services is subject to their respective terms and privacy policies.
8. Disclaimers and Limitations of Liability
8.1 No Warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
CertForge does not guarantee:
- That the Service will be uninterrupted, secure, or error-free
- The accuracy, completeness, or reliability of any content
- That use of the Service will result in passing any certification exam
We may experience downtime, delays, interruptions, or other service issues, and we are not liable for any resulting loss of data, access, or use of the Service.
8.2 Certification Disclaimer
CertForge is an independent study platform and is not affiliated with, endorsed by, or sponsored by any certification body, including but not limited to AWS, HashiCorp, Microsoft, or Google.
Certification exam outcomes depend on many factors outside our control. We make no guarantees regarding exam results.
The Service is intended to support your study process and professional development, but it does not replace official certification materials, provider guidance, or your independent judgment.
8.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CERTFORGE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL ARISING OUT OF YOUR USE OF THE SERVICE.
Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to CertForge in the twelve (12) months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless CertForge and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your User Content
10. Termination
Either you or CertForge may terminate your account at any time, for any reason.
Upon termination:
- Your right to access and use the Service will immediately cease
- You may lose access to your study progress and account data
- We may delete or anonymize your data upon termination in accordance with our Privacy Policy
- Sections of these Terms that by their nature should survive termination will remain in effect
11. Governing Law and Dispute Resolution
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
11.2 Dispute Resolution
Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
Arbitration will take place in Florida, unless otherwise required by applicable law or mutually agreed by the parties. You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit, class arbitration, or other representative proceeding.
12. Changes to Terms
CertForge reserves the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on this page with a new "Last Updated" date
- Sending an email notification to your registered email address
Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
13. General Provisions
13.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CertForge regarding the Service.
13.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
13.3 Waiver
No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term.
13.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. CertForge may assign these Terms without restriction.
